Since the photo may have been cropped, an original copyright search was done in artwork for the years 1935 and 1936. Though the photo is dated 1935, the film didn't premiere until 1936 and though the release on the back credits Universal with the film, it actually was done by MGM. There were no listings for either Freulich or Universal. MGM filed one copyright for 1936 on page 3821: "Lonely club (heart pierced by an arrow)". Nothing pertaining to the film or to the photographer was discovered; there's no evidence of original copyright on the photo.
The terms of the exclusive photograph stamped on back are as follows: "Portrait by Jack Freulich. The studio agrees to withhold submission elsewhere for 45 days. If not acceptable, please return." The publication was being offered an opportunity to be the first to print the photo. From the upside-down stamp at back, the publication was the St. Paul Dispatch.
